Sorry I should have clarified yes the property is a block of flats, the flat is normally sublet, tenant left weeks ago. The insurance broker wont talk to me about the insurance , data protection and my name is not on the policy so cant check it with them and they have refused to.provide me with an insurance...

Thank you for your help my lease is apparently poorly drafted unfortunately. The flat above is sub let to tenants on a short AST...6 months...when the 1st leak happened the water ingress came from the flat above let's call them Flat A so the flat below let's call them Flat D notified the MA straightaway...

Would water ingress be considered nuisance in accordance with the lease
The flat above one of our tenants has caused two separate water ingress issues to the flat below June and August, the issue is apparently either a faulty slow leaking stop cock or washing machine. They have asked to see a plumbers report and apparently there isnt one .The MA said no insurance claim...

Empty property over 45 days empty building insurance
One of our neighbours has left her property empty for over 55 days, does this or can this invalidate the building insurance and increase any costs to us?

As others have said above try the amicable approach otherwise get hold of three quotes for the work and send them to them with a statement saying that you will be getting the works done yourself that the works will be paid through the service charge. Get the works done based on a proper specification...
