  • did you expressly mark your two emails of "without Prejudice"? If not then given the subsequent correspondence I dont think you can rely on the typing error to invalidate the counternotice. Your case may well be distinguishable from Mount Cook

    but if you granted the tenant a wholly new tenancy then I believe you would be obliged to reduce the deposit down to five weeks rent

    I believe so. physically handing over the keys is the clearest indication that the tenant had no further need of the premises. Unless of course there is something not disclosed in your posting, such as an agreement that the lease would continue whilst the l/l marketed the property for new tenants.

    I think it is the landlord and tenant act 1954 you mean, and even a lease within the act is enforceable in the event of non payment of rent
