It also appears they may not be registered with MARLA/ARLA as well....

My friend also informed me that the place I live (not to my knowledge before I moved in here) Is a council block/social housing. He informed me that if the landlord who has a mortgage on this property hasnt actually...

so this would clearly be categorised as a sham agreement. For the people of this forum, what would happen now? I havent heard from my agency since thursday when they sent us the email saying they wont pursue the case.

    1) Does this mean a new AST contract would need to be drawn up?

i also sent the solicitor an email informing what else/could i claim compensation on/for? I am going to be completely honest, these last two weeks I have never felt so much stress. Not currently working, bills of around £2000 every month which needs to be paid for. Threatening with eviction and then...

Based on everything i said, you guys' said, and what the solicitor put in the formal letter to them, they e-mailed myself and my solicitor saying 'they will no longer be pursuing the matter'

    funny that isnt it......

I was on a 12 month contract, with a 6 month break, with then in turn me giving 1 months notice to leave.

In no where throughout the contract does it say I am a lodger. The title of the contract says CONTRACTUAL LICENCE AGREEMENT. Only in the e-mail to me from the agency did he write in...

the solicitor i spoke with went over the contract (now upon what you guys have told me and what he then told me i find it very hard to reconcile my thoughts)

he informed me that the contract does seem to stand but the only unfair thing is that they have given me 14 days notice, whereby...

Response came through whereby the agency said, If i continue to stay passed the date, I will be trespassing

It seems to me that the agency are exempt from any form of 'sections' which need to be handed to myself? The part where they said section 21 is not relevant in this situation?...

    Thanks,

I am currently not working. If I get 'illegally' evicted, I will have nowhere to go. If this goes through the due process, that would give me 2-4 months being in this property. I am also awaiting payment towards my bills/housing as a lump some and as well every month. This is why...

Thanks for your response. My outcome is that I want to be served correctly. That being said s21 which is 2 months minimum notice, then has to go to courts then has to be a possession order. That is the process I want.

And you said they have other ways and means of getting possession...?...

I notified the agency of everything you helpful people have said to me. I quoted 'street v mountford' and their response was that that has NO relevance to my stay whatsoever. They said that I signed a Contractual Licence Agreement (Lodgers Agreement)

    They also informed me that:...

This legal aid is proving to be quite difficult. They are either out of capacity or I cannot get through to any of these solicitor firms... very very annoying. All I want is for them to draw me up a professional/legal letter to send to them.

That was exactly my point. I do not want 20th February to come by, and I kept quiet, and then they come to the property and say 'why have i not moved out?' and start doing absolute nonsense etc etc...

So I think advising them that I seek the appropriate section 21 notice with the...

a legal aid solicitor i spoke to earlier said 'ill cut to the chase, do i live with the landlord? no. Is any of the tenants related to the landlord? no. Then you have an AST.

She then said contact the agency and tell them to serve you with the correct paperwork/notice

and that is exactly what the advisor said to me from shelter.

she said is my deposit protected? did i receive leaflets/flyers/documentations of this? i said no

she said how did they serve me the notice. I said they e-mailed me the notice. She said they should have sent a section...

    HMO?

that is correct, we all have locks on our doors.

So, when the 14 days comes round, and lets say for example on the day they decide to come and say 'am i moving out? why havent i moved out? what would be the next steps there for me to do/say?

    Thanks,...

Just gone over it. It doesnt say anything about anyone having access to my room i occupy apart from 'people i bring along to make sure it is kept safe and locked' etc

I live in a 3 bed flat in an apartment block. I occupy a room.

I have access to all the common areas (bathroom & kitchen)

Two other people live here. So in total it is three including myself.

the contract says 'this is between licensor and licensee' and proceeds to give name of the agency and my name. I was unaware that I was not a tenant.

Wanting to know if I have any rights for this?

The landlord does not live in the property....
