Is the "They" the council or the tenants (or both)?? Social housing is really really scarce (we know why), and if tenants will only go with council re-housing likely to be somewhere most of us wouldn;t want to be.. homeless B&B, hostel or 12months min private let probably miles and miles...

Think that until legislation/regulations are passed and enacted we won't know. Sadly I've mislaid my crystal ball - the only thing of which can be said it's usually not crystal & often balls...

Is this a rental property and does he report his income from it to HMRC?? 3 months for an inspection?? Once a month to check and inspect what?? - his rental properties in UK?? ?? Clearly cheaper to employ someone to do it here in UK. Can't see that standing up to a HMRC investigation.

Defend the case with MCoL with the evidence you have of never agreeing, inventory, photos etc etc. Why do you think it is a fixture & fitting & why did he not take it with him??
He's at liberty to bring a case: You are at liberty to defend.

Unless something very odd in terms you agreed with solicitor (ie read them, again..) you should pay. Or argue with whoever agreed those terms on your behalf.

AFAIK for UK, only Scottish PRT tenancies have notice to leave. Did you mean that ? Or s21 or s8?

But yes, tenant (who may be viewing this thread..) holds all the cards. Were it me I'd want at least £10k, but I'm a greedy landlord.
HOW and how documented is the purchaser paying?? Might interest HMRC on price,...

Even if you moved back in they would still be tenant. It's the situation when tenancy started that matters.
Of course if brother offers new tenancy at lower rent, providing tenant surrenders their tenancy, moved out for a couple of days ..... But I somehow doubt you'll all understand the...

Who is named as landlord in tenancy agreement ?? (Yes, appreciate address may be c/o "agent).
You don;t have to own a property to be the landlord.

Those 11 month's rent sound so like a deposit - see legal definition... s.212(8) Housing Act 2004

Inform your esteemed tenant (I suggest verbally only) you'll be reporting him to HMRC for his rent income & DWP likewise (bet he's claiming some benefit): But if he ends tenancy, with vacant possession, won't. See what he does.

You are named as sole landlord. You do not live there. Tenant.
So lodger's agreement is sham, actually an AST but missing or incorrect paperwork, impossible to evict.

Since g14 is discretionary whereas s21 is (usually) guaranteed if paperwork perfect I'd go with s21. Have you checked your s21 against
