    First Tax return

    Im just getting my head around my first tax return and completing it shortly, my question is the house i rent out would have been marketed prior to its original marketing date if it wasn't for the freeholder playing hard ball and me subsequently having to buy the freehold prior to renting the house.

    Can i claim for the council tax, bills etc for that period of it being"empty" as it was a 6 month void prior to it being rented?

    I know i cant claim for buying the freehold.

    If the flat was ready and available to let, you can claim the council tax expenses for the period whilst waiting for a tenant.

      Hi does that mean as the house was ready to rent prior to the freeholder (at the time) causing me issues i can claim for that period as well as it would have been rented if i didnt have to go through purchasing the the freehold (something i didnt plan on doing)

        See hmrc guide on expenses incurred before start of letting : http://www.hmrc.gov.uk/manuals/pimmanual/pim2505.htm

        Its an expense chargeable after start of letting and so therefore can be allowed if incurred before start of letting.

          I'd suggest that based on that description, all of the work was probably capital.

          I believe your solicitor has to prepare a Deed of Trust which transfers 60 % interest in the property from wife to you.

          You need to make clear to your solicitor that Deed is for HMRC only and not for registration at Land Registry

          The Declaration changing the beneficial interest to 70:30 is prepared only for showing to the Tax Office .

          The existing registration of 10% :90% legal interest at Land Registry does not change and the Mortgage Lender has already accepted this situation. .

          Hi. My solicitor has told me the declaration needs to be registered with the land registry otherwise there will be no effect of creating the declaration. Is this correct?

          I have also spoken to my lenders and they have mentioned they will want a new copy of the title. I mentioned to them...

          1.Pretty sure I read there is no limit! and to give kids the reigns if older brcause you cant transfer losses. perhaps was a different tax i read for though
