    Capital Gains Tax on multiple property sale

    I am currently serving in the Army and therefore live in Forces Accommodation. My wife and I purchased a property for £85,000 five years ago and have let it for the period to date. We purchased a second property in Sep 05 for £135,000 which is also let. I have now moved both morgages to 'Buy-to-Let (in case that has a bearing). I intend to build my portfolio until such time as I leave the Army so that I can invest any profit made into our own property in which we will take up residence for retirement.

    Am I liable to pay CGT on all properties when sold if the profit is re-invested in another property?

    The simple answer is YES.

    However, you should read the Inland Revenue Help Sheet IR283 downloadable from the Inland Revenue website. In particular, you should be aware of the details under the paragraph headed ''Job-related accommodation''. If necessary, you should take professional advice in this respect. It may be that you intended to occupy the 1st property as your main residence and that this intention has now changed to your 2nd property. In this event, it may very well turn out that your original property is exempted to-date (plus the final 3 years ownership) as your PPR even if you haven't lived there at all. Furthermore, your 2nd property may then start qualifying until you change your intention again.

    It is best to get your thought process clear so that you don't lose the valuable PPR relief due to ignorance or carelessness.

    If you are not clear, I strongly urge you to seek professional advice without undue delay. This is in your best interests. Believe me, this will be money well spent.

      If you are living overseas, you must register as a non-resident landlord using NRL1 form to Tax Office if you receive rental income from a UK property. If you don't register , the letting agent is required to deduct 25% tax on any rental money paid to you.

      I've been thinking of reporting it for a while. If I declare these past "earnings" do you think I'll just have to pay the tax (if there is any) or do you think there will be any penalties? Penalties are usually applied when you are caught out...

      I don't know what the situation is with Australian tax on UK rented property, and you'd probably better enquire locally.

      There are two different things to address.
      If you've been receiving income and not declaring it, you need to own up and pay what you owe - which sounds like nothing...

      Your questions are more complicated than you imagine.

      1) Yes, firstly as a non resident landlord, the agent or indeed tenants have to deduct tax at source, or you have to send off a form, but also wait for HMRC to send confirmation that they think it is okay for you not to have the tax...

      Even if you don’t need a licence, managing an HMO can be quite onerous. You’ll need a fire risk assessment, and then to comply with its requirements as a first step.

      That usually means fire retardant doors, different door locks, hard wired fire and smoke and heat alarms for a start....

      Thanks. Yes I checked the local authority who said that only "large" HMOs have to be licensed, and that counts as 5 or more tenants.
