    Tenants in Common SDLT??

    Can anyone please tell me if SDLT 3% surcharge will apply only to the 30% stake owned as a second home (by me) and not the 70% owned by my partner as his primary residence? (ie; everything above £125k)

    Sorry to say, but the benifical share does not matter. If even one of the legal owners has a share in another proeprty then the 3% surcharge will apply to the entire purchase price. Does not matter about the share split, one person affects the whole title.

      The extra 3% SDLT charge is charged if the joint buyer already has a property registered under their name.

      However the 3% extra charge does not apply if the buyer is moving from old main residence to a new main residence.
