    holiday property - EPC required?

    I understand that you now have to have an EPC for holiday lets in England. Is this also the case in Scotland? I would be grateful if anyone who knows could let me know if I will have to waste money on this!

    Have tenant on 6 month short assured tenancy, I included all bills and council tax in the rent as it was short and I am planning to move back into house. Tenant stopped paying rent after 3 months and not leaving at end of tenancy, solicitor now dealing with eviction process.

    Sure solicitors can be wrong, especailly if they don't usually work in the area in question. The problem is you generally have no idea who's right and who's wrong if what you read on a forum differ to that of your solicitor's advice.     Included in the rent may be enough, but even if not, all she could do is sue you for the payment and then you would counter claim the rent.

    There is, however, someone on the forum who used to work for councils on council tax, and may be able to give a more definitive answer.

    Why are you taking advice of some stranger over the internet over that of your solicitor ? Anyway, if you feel like doing that...

    The council tax liability rest with the tenant assuming you're not living there, inside a fixed term of at least 6 months or they're currently occupering...

    Thank you,
    Tenancy agreement states all bills(water gas electricity) and council tax included in rent.

    This was a one of rental by me to a family friend (not now) so I was not as clued up as I should have been about the pitfalls in being a landlord.

    I don't think you were ever responsible; you were simply acting as the tenant's agent.

    More precisely, any liability you have will be to the tenant, not the council, and will be the result of the precise wording of the tenancy agreement. Hopefully it makes payment of bills conditional...
