Tenant has a SAT (issued prior to December 2017) how much notice do I need to give for a rent increase? I’ve checked the agreement and it doesn’t make any reference.
Rent increase - Scotland

What happened after the initial fixed term ended? Did the tenancy automatically renew itself for the same length of time or did the tenancy agreement renew for a different time period eg monthly?
Are you positive the tenancy is a SAT? Did the tenant receive an AT5 form before the tenancy commenced?

Welcome to LLZ.
SaL have a form for this with details etc on their website, for members...

Yes, can your prove tenant got AT5 prior to signing SaT?? (I got that wrong once...)I am legally unqualified: If you need to rely on advice check it with a suitable authority - eg a solicitor specialising in landlord/tenant law...

The issue is, can you prove you served AT5 on tenant prior to them signing tenancy.
If not, if tenant disputes the matter, ftt/court will probably decide it's an AT not a SaT.
Rent increase not impacted by this, but eviction would be a challenge (nigh on impossible with no arrears).
The old advice was have landlord & tenant sign, time and date AT5, then (later time) likewise SaT.I am legally unqualified: If you need to rely on advice check it with a suitable authority - eg a solicitor specialising in landlord/tenant law...

The amount of notice your landlord gives before the rent increase takes effect must be at least one rental period (so if you pay your rent monthly, you must receive at least one month's notice before your rent goes up).
When I last increased rent on a SaT I simply emailed tenant, informed her planned rent increase of £xx/month, and she then started paying it... Not certain of the legalities of that in Scotland (e.g. if one later wished to evict for rent arrears or claim the rent arrears..)I am legally unqualified: If you need to rely on advice check it with a suitable authority - eg a solicitor specialising in landlord/tenant law...

I have recently instructed Sheriff Officers for the grant of a Charge for Payment at a cost of £103.24. They needed the Tribunal’s Payment Order. Does the...

by Sheena McQThe joint tenant on the FTT Payment Order is now resident in England. Does anyone know how I can enforce payment in England using the FTT Order? England don’t have Sheriff Officers.

by DoricPixieThe outcome of FTT hearings is freely available online so landlord can search there during the referencing process.
20 years seems like a hell of a long time but then I’m not a solicitor. Debts in Scotland become statute barred after 5 years so I’d be inclined to agree with the sheriff’s...-

by Sheena McQThe FTT Payment Order isn’t recognised. The trust online.org.uk only holds records for “Scotland Ordinary Causes, Small Claims Summary Cause and Simple Procedure Decrees”

by DoricPixieDecrees issued by the sheriff court are supplied by the court to the Registry Trust which in turn reports the decree to the credit reference agencies.
Presumably you can’t find anything for the tenant when you search the Registry Trust?

by BTL_LandlordHi All
I have tenants in one of my BTLs that have generally been fine in terms of paying their rent each month, up until last year. They went quiet on me, infrequent or no replies to text messages etc ... except when they wanted something of me! Eventually I wrote to them (signed for...-

Reply to Arrears - frequency of communicationby DoricPixieYes, that is the same as I said. I think there is still the potential the FTT won't grant an eviction order even if 1 month's arrears are owed at the time of the hearing.

Reply to Arrears - frequency of communicationby BTL_LandlordThanks. I've had clarification from the letting agent who advise it's any arrears amount over a 3 month consecutive period before the LL can instigate eviction process. Then, at point of FTT, if arrears still equal or are greater than 1 months rent, eviction might be granted, however FTT treating more...

Reply to Arrears - frequency of communicationby DoricPixieBTL_Landlord,
I wonder why the letting agency drafted a tenancy agreement themselves when you can it for free from the Scottish government. In any case, the clause you quoted doesn't say there only needs to be 1 month's arrears before the eviction process can commence. It is not very well...-
