    Hi my factor came round today and told my ex who was looking after our children that I was behind with my rent is this ok?

    Sorry i am not familiar with what a '' factor '' is ? But as a general rule telling anyone other than the person who is responsible for any debt the details of said debt is wrong.

      Is this Scotland?

      Is "factor" the person named as landlord on the tenancy agreement?
      I am legally unqualified: If you need to rely on advice check it with a suitable authority - eg a solicitor specialising in landlord/tenant law...

        Sorry yes the factor is the agent of the landlord and yes I live in Scotland.

          Can I also add i have been in the house for 10years and am only 1 month behind with my rent which will be sorted this month. I am just really angry that my personal information was given to someone else especially my ex.

            Is this a SaT tenancy or a PRT one, please?

            You'll appreciate that even being only 1p in arrears provides the landlord/his-agent with grounds to apply to the tribunal to evict you (unlikely to succeed but...)

            Will you ever need a reference from landlord/agent or factor?

              It does not seem right that the letting agent showed up at your home unannounced let alone mentioning that you are in arrears. You can complain to the letting agency using its complaints process.
