    Incorrect service of AT5

    I have just discovered that the letting agent I used to let a property for the first time, had the tenant sign the tenancy agreement first, followed by the AT5 for a SaT.
    The tenants remain in the property after several years and have conducted the tenancy without issue.
    By my understanding an Assured Tenancy has been created by default due to the Lettings agent lack of diligence.
    Has anyone here had experience of this; if so how did you deal with Agents/tenants?

    I agree, an AT not SaT.

    What do you want to achieve? If eviction try SaT route, tenant may not realise the error & leave.

    Or offer a fresh new PRT: Any sensible tenant would sign.

    And fire agent.

    At this point you've suffered no £££ loss so I doubt you yet have a case.
    I am legally unqualified: If you need to rely on advice check it with a suitable authority - eg a solicitor specialising in landlord/tenant law...

      Thanks for the response, sorry for the delay in replying. Going to sit tight for the moment & hope we have no need/ reason to end the tenancy!
