    Advice needed

    So my saga with the landlord continues.
    enviromental health been a done a check also.
    So as it goes my back boiler is condemned so have a emersion and to oil filled heaters which enviromental health say is fine.
    There checks found I needed a new fuse board and tails done also found I need smoke alarms upgraded as I only have one and there's a broken window catch and I need a bath panel.
    The concern I have is the no gas situation ok just now but come winter how's that acceptable the boiler is still in situ full of water and I have a hideous fire that I can't use with a fancy warning label the gas meter needs removed as I pay a charge for something I can't use but apparently this is fine anybody got advice on what I can do next don't say move it isn't possible can't afford that. I have a AST with over a year to go.

    Contact the local private sector unit in your council- they deal with private landlords

    If you had working central heating then the landlord has to maintain it and repair it throughout your tenancy

    What is the repairing standard?

    A house meets the repairing standard if:-

    (a) it is wind and watertight and in all other respects reasonably fit for human habitation,

    (b) the structure and exterior of the house (including drains, gutters and external pipes) are in a reasonable state of repair and in proper working order,

    (c) the installations in the house for the supply of water, gas and electricity and for sanitation, space heating and heating water are in a reasonable state of repair and in proper working order,

    (d) any fixtures, fittings and appliances provided by the landlord under the tenancy are in a reasonable state of repair and in proper working order,

    (e) any furnishings provided by the landlord under the tenancy are capable of being used safely for the purpose for which they are designed,

    (f) the house has satisfactory provision for detecting fires and for giving warning in the event of fire or suspected fire, and

    (g) the house has satisfactory provision for giving warning if carbon monoxide is present in a concentration that is hazardous to health




    The repairing standard duty includes a duty to make good any damage caused by carrying out works whilst complying with the duty.

    Because the central heating was installed at the start of the tenancy it must be maintained, repaired or replaced.

    It's an assured short tenancy, I moved in Jan 2017 on a 5 year lease.
    council say that the 2 oil filled heaters are ok although need pat tested, my social worker reported a concern with electrics and they seemed that the fuse box and tails need done aswell as a full check. Then there's a window catch and absurdley a bath panel.
    I didn't sign a AT5.
    Landlord made contact regarding electrics and fire detection but still awaiting a date.
    Council are just allowing him to carry out work as and when no contact has been made with myself from council.

    Just to double-check, "Assured Short Tenancy" (in that order?) not "Short Assured Tenancy"? (Your rights will be different depending on which it is).

    Were you served a form labelled AT5 before you moved in? When did you move in, please?

    What are council saying they will do?

    Suggest you speak with Shelter & write to the "First Tier Tribunal" who sort out Landlord/tenant disagreements.

    Thanks: Is tenancy document headed "Assured Shorthold Tenancy" or "Short Assured Tenancy" (important we know, please!).

    Suggest you 'phone Shelter Scotland from 09:00 tomorrow on 0808 800 4444. And write, keep copy, of all repair issues using Shelter's process and draft letter here.

    Yes am in Scotland AST was signed before Dec 2017.
    all repairs were reported and I have copies of emails sent. In march this year boiler was due annual mot and failed spectaculary.
    then enviromental health got involved and came back with there findings this is due to my social worker reporting concerns

    You are in the Scottish section yet mention having an AST, only available in England or Wales: Before replying, please confirm which country your property is in, please.

    Have you reported these issues, in writing, keeping copies, to landlord and any agent, please?
