Good points that the law is biased towards tenants .
But it still leaves us landlords in an impossible situation.
Eg tenant texts to say moving out
tenant empties property
tenant refused to sign deed
Landlord enters empty property
landlord is sued...

I have other HMO's in the city. As said above, this as c4 planning permission as the area is under article 4. It doesn't however require a HMO license.

I don't think the pandemic will help that much.
You go through life either following the rules or you don't.

Reply to Preaction protocol for rent arrearsby jpkeatesThere's nothing about disrepair that allows a tenant to withhold rent.
To succeed totally in a counter claim, they'd have to be able to claim a loss that was equivalent to the rent owed, which would be difficult unless the whole property was uninhabitable.

I have read that I am obliged by the Court to follow the preaction protocol before issuing proceedings. The document seems a load of old tosh.
I need to bring a MCOL against a tenant who ran off leaving £16,000 rent arrears.
