    Sorry you're right it's the section 8 whereby we would look to accelerate the tenant vacating the property.

    I have other HMO's in the city. As said above, this as c4 planning permission as the area is under article 4. It doesn't however require a HMO license.

    The main obstacle is the high cost to a local authority of a prosecution.
    I don't think the pandemic will help that much.

    You go through life either following the rules or you don't.
    When you don't, you lose the high ground - behaving badly because your tenant has behaved badly...

    Hi everyone I had a real difficult tenant and they have left and owe me thousands. Which doubt I will see.

    they have left a TV worth about £15 and and normally I would never do this but seeing it as I'm not going to get any money out them

    There's nothing about disrepair that allows a tenant to withhold rent.

    To succeed totally in a counter claim, they'd have to be able to claim a loss that was equivalent to the rent owed, which would be difficult unless the whole property was uninhabitable.
    They can probably argue...

    I have read that I am obliged by the Court to follow the preaction protocol before issuing proceedings. The document seems a load of old tosh.

    I need to bring a MCOL against a tenant who ran off leaving £16,000 rent arrears.

    Yes, it's an HMO, but an AST is fine.
    It may not need to be licensed, but the regulations are broadly the same anyway.

    House has been let to 4 tenants on an AST. They are a couple, plus two single friends. Does this mean it should be an HMO and should not have been let on a AST basis? Your feedback would be much appreciated. TIA.

    I have a tenant who's leaving shortly and a letting agent sent through letter asking for a reference for the tenant, in the letter there was also 4 pages of questions about 120 to be precise.

    I know it will take best part of a hour as quite a few are detailed and require looking...
