If his notice is valid, when it expires the tenancy ends.
You could seek possession through the courts without the long delays imposed by the need for notices served by a landlord, but the eviction stay would still apply.

Hi guys, new to this forum so please be kind to me. It seems a great fountain of knowledge and I was hoping some of you may be able to advise on a current predicament I have with an existing tenant.

The tenancy commenced on 8th January 2021 on a 6 month fixed AST.

    The tenant...

I wouldn't have told the LA that "I refuse to complete x, y or z" as the word REFUSE lodges a negative thought in their heads lol - and they go on auto-pilot thinking the worst - which is what happened in your case.

I would have offered to provide a basic 2 sentence response if...

    Hi,
I have a tenant who's leaving shortly and a letting agent sent through letter asking for a reference for the tenant, in the letter there was also 4 pages of questions about 120 to be precise.

I know it will take best part of a hour as quite a few are detailed and require looking...

Good points that the law is biased towards tenants .

But it still leaves us landlords in an impossible situation.

Eg tenant texts to say moving out
    tenant empties property
    tenant refused to sign deed
    Landlord enters empty property
    landlord is sued...

Hi everyone I had a real difficult tenant and they have left and owe me thousands. Which doubt I will see.

they have left a TV worth about £15 and and normally I would never do this but seeing it as I'm not going to get any money out them

They want to collect it , I'm thinking...

Sorry you're right it's the section 8 whereby we would look to accelerate the tenant vacating the property.

I have other HMO's in the city. As said above, this as c4 planning permission as the area is under article 4. It doesn't however require a HMO license.

    Regarding the...

The main obstacle is the high cost to a local authority of a prosecution.
I don't think the pandemic will help that much.

You go through life either following the rules or you don't.
When you don't, you lose the high ground - behaving badly because your tenant has behaved badly...

  • Reply to Preaction protocol for rent arrears
    by jpkeates
There's nothing about disrepair that allows a tenant to withhold rent.

To succeed totally in a counter claim, they'd have to be able to claim a loss that was equivalent to the rent owed, which would be difficult unless the whole property was uninhabitable.
    They can probably argue...

  • Preaction protocol for rent arrears
    by GivemylovetoJudy
I have read that I am obliged by the Court to follow the preaction protocol before issuing proceedings. The document seems a load of old tosh.

I need to bring a MCOL against a tenant who ran off leaving £16,000 rent arrears.

The tenant sent me an email saying that if I sued...
