  • Reply to Applying to Court for Section 21
    by jpkeates
Unfortunately, this means that the notice wasn't correctly served and you might find that the court doesn't accept that the notice is valid.

The Royal Mail doesn't record why post sent requiring a signature is not delivered, and it's quite possible that the intended recipient simply wasn't...

The first thing is to establish whether the S21 is valid and deemed served.

Recorded delivery is not generally recommended here since the recipient can refuse it.

What do you mean by 'did not accept this'. Did they turn it away?

    And as to whether...

Looking at the news today (similar to yesterday and the day before), they are talking about combined energy bills of 4-5k a year...... by April 2023. There are many properties up north where the combined rental per annum is between 6-7k....... that is insane.

    Could we have a situation...

Under the Limitation Act 1980 the limitation period for recovery of ground rent is 6 years. This means that your landlord can only seek to recover ground rent going back 6 years. I would try and get in touch with the solicitor you were dealing with to see if the Freeholder has died etc.

So you lived in a boarded up council property, but entered legally through an insecure window? How? If it was "insecure" you mean it had a welcome sign above it or you managed to climb in because the "keep out" boarding wasn't fastened securely enough. Does a burglar enter legally...
