Yes then take legal advice regarding serving a notice to quit on the basis that you cannot allow a tenant to live in a property which is unsafe and you have been denied permission to effect repairs....

What sort of mortgage are you expecting?? If not a buy - to - let mortgage, sounds like fraud to me.
I'd not rely on tenant in these circumstances. And the "Hunter" system the lenders use to track who lives where would very very likely spot the cunning plan and assume something...-

I have been told by the manager of the assisted living accommodation where I reside that if I do not use the CPAP Machine (which I can not stand) that the NHS has supplied me with for my sleep apnea he will in other words evict me, ability housing (a housing association) is my landlord which the manager...

A criminal conviction isn’t necessarily necessary but it all helps. It is also a discretionary ground so currently it does make more sense to use the mandatory Section 21 route but who knows how the Section 8 might be...-
