    Not got EPC certificate; How do I evict?

    Hi,

    Have a tenant who is over 2 months in arrears. So have issued s8 & s21. Tenant on AST periodic now.
    Realising that a Section 8 eviction route is not always watertight I thought I may rely on the S21 process. However I have forgot to get my EPC done! Have the other prescribed documents. He moved in 27th April 2016. Eviction process started 28 December 2016. What can I do to rectify the S21 route? Can I if possible have the EPC done now. Thats if tenant will allow me access (relationship strained). Or is it to late? Any advice would be appreciated.

    Are you sure there is no EPC? When did you purchase the property? Any sale in quite a few years now needed one as part of the pack, and the EPC lasts for 10 years on the property.

        If you get a chance, explain to tenant (verbally, not in writing..) that due to s8 & rent arrears you feel bound, as a good patriotic citizen, to inform council who will then deem them "intentionally homeless" and not help/re-house: But you are happy to agree to an early surrender any date she wishes to leave (eg at 16:23 this afternoon!).

        Good luck: You will, eventually, evict, one legal way or another.
        I am legally unqualified: If you need to rely on advice check it with a suitable authority - eg a solicitor specialising in landlord/tenant law...

          What artful says. I always let the council know about eviction for arrears, asking the council to help. The council are well aware that some tenants use this 'trick' as a way of attempting to jump the housing queue.

            Would o/p still need to 'serve' the EPC document on his tenant?

              the tenant has beat me to the council! He's notified them of my intentions to evict and is pressing them for housing benefit to help pay his arrears. However come Thursday 12th his time runs out. Even if he makes a payment towards the arrears I want him out because hes not someone I want to deal with any longer.
              Would you still advise me contact the council and give them my take on the situation, will it benefit me in anyway?

                Just state that an EPC update is required ( do not mention you don't have one ) and that he must allow access to ensure the items that are normally tested, meet the prescribed standards.
