    Ending a tenancy - when can I go and when is my last payment due?

    I apologise in advance if this is a simple question.

    My 6 month fixed term tenancy started 15th March 2014 (via LA). I paid my fee, deposit + rent in advance as normal.
    From 15th September 2014, my tenancy turned into a monthly periodic tenancy.

    I pay my rent on the 15th of every month so I'm covered until 14th of the following month.

    I am now looking for another house but hoping to move before Christmas.

    If I hand my notice in on or before 14th December would I be able to move out from the 16th December on-wards? Would my month in advance cover 15th Dec-14th Jan or would I still have to part with the full rental payment and the "month in advance" covers 15th Jan-14th Feb?


    Your notice needs to give one full month and end on a rent pay day. So if you give notice on the 14/12 you can leave on the 15/01 without any further rent payable. However if you remain in the property beyond that date then you will be liable to pay another full months rent. So yes you could move out on the 15/12 but pay the rent until 14/01.
    Any advice I give is my opinion and experience, I am as you also learning.


      You can move out any time - this afternoon if you like. But unless valid, at least 1 month notice, in writing, expiring end-of-period you remain liable for rent
      I am legally unqualified: If you need to rely on advice check it with a suitable authority - eg a solicitor specialising in landlord/tenant law...


        Your 1 month NTQ must end at end of a rental period (14th) as defined in AST.
        Rent payment day is not nec the AST Rent due date. NTQ is not rescindable.
        I assume rent is payable pcm.


          Yes, it's pcm and not 4-weekly.
