    section 8 (query)

    Good Morning all,

    Novice here, any help would be appreciated.

    I have a tenant with AST of 6 mths it started 10/7/16 as of Sunday 30th October they will owe 8 weeks rent, can I then issue a section 8 informing them of my intention to go to court for possession giving them 14 days notice... or will I still have to wait until the AST finishes on 9th January 17.

      I'd send both s8 & s21 (after 10th November) , but only act on the s21.

      The delays & costs that will be generated by acting on the s8 will make you wish you went the s21 route around March time.

        You can however serve an s8g10 if only 1p is underpaid for only 1day.

        Might send them a message. You might have "professional tenants" who understand the rules and laws better than we do.

        What were credit & reference checks like?
        I am legally unqualified: If you need to rely on advice check it with a suitable authority - eg a solicitor specialising in landlord/tenant law...
