I have agreed distribution of deposit with tenant and submitted same to Deposit Scheme. To date, tenant has not responded to Deposit Scheme to formally agree. What is my next step?

I have been messaging tenant but she just replies that she is overwhelmed with move, etc and doesn't respond to dps. I just don't know what next step is if she continues not to bother to act. We have agreed on amount to come to me (landlord) and what amount will be refund to her. (Tenant) by message. She no longer lives locally so I can't visit her in person to discuss.

Just leave it, its not up to you to chase the tenant. You have agreed a deduction which as been applied the rest of the deposit has been returned so its up to the tenant now, why are you chasing the T?
Was this a custodial or insured deposit protection?Any advice I give is my opinion and experience, I am as you also learning.

Ok so the TDS has time limits right? Assuming this is a custodial protection the LL has applied to the TDS for a portion of the deposit to be paid to them. I would have thought the TDS will write to each party notifying them of this and set time limits to respond and if any party fails to respond the TDS distributes the deposit??Any advice I give is my opinion and experience, I am as you also learning.

by ash72Are we missing the point here, by passing the legally binding tenancy agreement which stipulates how and where notices, issues etc are meant to be sent to and addressed to, should be enough (otherwise what is the point of it all). The median time from claim to possession order (which is 60 odd percent of the time, the result) is under 11 weeks (say just under three months), so from that point, possession is pretty much inevitable.
So it's frustrating, but...-

Can't agree more: Such information (landlord, address..) should be available for free, 24/7, not requiring £3 spend.
As in Scotland from the landlord register (I've had prospective tenants telling me they'd checked me out before viewing .. fair enough.)
But in England...-

by jpucng62If the property is now in good condition then you might suggest there should have been a £100 pcm rent rise for the first year - when you got a reduction - and a further £100 pcm this year, so £1700. If market rate is around £1800 then I would think this reasonable.

Reply to Section 21 During Contract Periodby ash72They can serve notice on you during your contract, but can't act upon the S21 notice until the expiry of your contract. They can serve you with a S8 notice during your fixed term contract.
