    Agent using photos of my stuff

    Hi all,

    I'm not sure if this is the correct section or not, so sorry if I'm wrong.

    I rented a flat for a few years and left about 2 years ago. When I moved out, the agent came over to take new photos for re-advertising and I had no objection at first.

    When I saw the photos they wanted to use I spoke to them and asked them to remove any photos containing images of myself, my wife or my son (only about 4 out of 12 images) and they did so promptly.

    I've just noticed that the property is now being sold and they are using the same photos as before including the ones I previously asked them to remove.

    I'm going to email them to ask them to take them all down (they're over 2 years old now anyway) but what can I do if they ignore me or refuse?

    Anything?

    I suspect there is nothing you could do to force them to remove them.
    I would ask for the photo's to removed and deleted so that this doen't happen again.

    I would call them in the first instance, and follow it up by e-mail.
    Allow tenants to protect their own deposits. I want free money when they do it wrong

      Require that the photos are destroyed, copy to trading standards & relevant redress scheme

      Unlikely you can force a fix.
      I am legally unqualified: If you need to rely on advice check it with a suitable authority - eg a solicitor specialising in landlord/tenant law...

        Photographs of (living) people are personal data and you should point out that they are being used beyond the purpose for which they were originally captured.
        They should be destroyed (not merely not used).

        That's not absolutely correct, because you allowed them to be taken for marketing, which sounds like what they're being used for, but should stop the agent.
        When I post, I am expressing an opinion - feel free to disagree, I have been wrong before.
        Please don't act on my suggestions without checking with a grown-up (ideally some kind of expert).

          This sounds very odd to me. I've never seen a human being in a property advert.
          To save them chiming in, JPKeates, Theartfullodger, Boletus, Mindthegap, Macromia, Holy Cow & Ted.E.Bear think the opposite of me on almost every subject.

            I don't think OP did allow them to be taken as such. Sounds more like they didn't realise until they saw the pictures that the agent had included their family members in the photos:
