    Section 48 and Section 3 Draft

    Hi

    I am the new landlord of the property, I bought the property in auction. Could you please help me providing the draft for section 48 and section 3.

    Is this a new, different, purchase or same one you asked about before?
    I am legally unqualified: If you need to rely on advice check it with a suitable authority - eg a solicitor specialising in landlord/tenant law...

      this is same completed recently, do you have draft of section 3 and section 48

        What have you been doing for last month?
        Obviously not yet served s48, until you do no rent is due to you,
        Have you properly protected T deposit and provided PI & other red documentation?
        Joined NLA/RLA or undertaken any LL training? They have up to date documents library.

            The tenant must have an address, not the address of the new landlord.

            Most probably the tenant already has an address so there is no issue with the rent not being due. The issue is that OP may not receive notices sent to that address.

              s48 requires an address (in England or Wales). s3 LL&T Act 1985

              In this Act—

              Criminal offence not to supply promptly, sadly AFAIK rarely prosecuted.

                A rented flat with a toilet (of course) and basin next to the kitchen, and a bedroom with a quite small en suite - shower/basin/rail for towel ... Is this acceptable in a flat - with no additional separate bathroom?

                There are a number (of the order of 20) of grounds under which possession can be sought. See the Housing Act 1988.



                The claim is for the period for which they were paying rent whilst there was no required licence in place, up to a maximum of 12 months. Getting a licence ends...
