    He's started the process of evicting your flat mate, he's actually succeeded with you and is now going to instruct bailiffs to remove you.

    The s21 notice relates to a specific tenancy (the latest/current one) and it would be helpful to bring the issue to the judges attention.
    The s21 notice doesn't have to include a reference to the tenancy, so it's not automatically going to make it invalid.
    When I post, I am expressing an opinion - feel free to disagree, I have been wrong before.
    Please don't act on my suggestions without checking with a grown-up (ideally some kind of expert).

      The court papers that the landlord fills out ask for the first tenancy, and then any subsequent ones.
      I don't think the court would definitely rule it invalid, as it is likely that it wouldn't make any difference.

          All councils do that.

          I always tell my tenants to not fill out a defence, as they will get housed quicker.
          For example, if you get an extension of 4 weeks, all that does is give the council 4 weeks to do absolutely nothing. It's not like they use the 4 weeks wisely.

              I am legally unqualified: If you need to rely on advice check it with a suitable authority - eg a solicitor specialising in landlord/tenant law...

                  No of LLs prepared to accept LHA Ts (unless in part time work) is decreasing mainly due to such T debt on increase, HB sanctions and increase in LL Insurance for said Ts
                  When s21 expires, you will already have had 2 cal months to prepare for the inevitable move. Delaying until legally evicted could cost you £380, same for any T. Or you can hire a van & man for the day.
                  Ts should start saving for next move at start of current T

                    Yes we be packing but just no where to go its a long story how we got the property we got scammed by a man claiming to be the landlord gave us tennancy keys etc moved in and real landlord came it caused dramas we managed to get to.keep.house after council took case and found out the man who gave us the property and landlord were related. But they scamed a lot of people and made over 20,000 in a month in deposits and rent in advance from loads of people. So yeah been to.l much darma to be honest

                      Gosh, that sounds pretty awful.

                      I think you said you are vulnerable and have a case worker. When the time comes, get the Homeless department and your caseworker to liaise with each other - being vulnerable will help more. I fear though in the borough of Greenwich, anyone taking full HB it won't be a quality property. If there aren't any properties available in your price range, you will probably get discretionary HB to top up the rent but this in itself will be hardwork and will be reviewed frequently. The council will have a list of Landlords who do take HB. If you are below 35 years old, you might only get rooms in a shared house.

                      I do feel sorry for people reliant on HB but being a Landlord I have suffered the consequences and fully understand why Landlords will not accept HB tenants. More often than not, it is a nightmare.

                        I think the complete opposite. Discretionary housing payments are for short-term fixes in rent.
                        I can't see a council giving one for a new tenancy where a tenant has just moved into a property that they couldn't afford from the outset.

                          a) so the mobile home does not provide the (very) basic facilities that any tenant or judge would expect for a dwelling....
                          b) Agree with jpk: Should it get to court (which is when the issue matters..) can;t see any judge deciding it's anything but a tenancy & you the landlord er... not at...

                          It's almost impossible to reset the tenancy with a new agreement.
                          The buyer will inherit the previous tenancy at the same point that they're able to let the property on the new agreement, so any new tenancy is going to be a follow on tenancy.
                          So things that need to be done at the very start...

                          You're really going to struggle with that not being a tenancy.
                          If the tenant can lock the door to exclude you, and they could wash in a sink, that's likely to be a dwelling house.

                          How basic is your understanding?

                          From your other thread you are seeing a broker about a BTL mortgage. I think you will struggle to secure a BTL mortgage against a property with a Regulated Tenancy in place....
