    Newbie question about end of tenancy

    I am a first time landlord letting out my property on an AST for 1 year (with 6 month break clause). The AST is due to end in 3 months.

    I was previously under the impression that when the tenancy reaches the end date the tenant would just move out and I would get my property back.

    However from what I have read I believe that I need to serve Section 21 in order to get possession, since if I do not do this the tenant can carry on living there and it becomes a periodic tenancy.

    Is this indeed the case? If this is true what is involved in serving section 21 is there some special form that needs to be filled in?

    Are you for real? Did you really let your property out without even finding out what you had to do at the end of the agreement?

    If you really are for real then try this. Google for "section 21". I did, and I found this: http://www.lettings-landlords.co.uk/info/sec_21.html.

    And make sure you do it right, or your tenants might really screw you around :-) but I'm tempted to say that would serve you right for not doing your homework before deciding to let your property out...

      RK164,

      A free copy of a S.21 notice is available to download under the agreements section of this forum.

      It is an easy form to complete ( Make sure you get your dates correct ) and then deliver this to your tenant.
      You must give at least 2 clear months notice of possession required to your tenant.

      Also, you may want to read some more of this forum so that you know what you should or shouldn't do in the future.

      Lack of knowledge will only lead you into trouble.

        Why do you want the property back? Did you inform the tenant you intended to evict at the end of the fixed term?

          I don't want the property back, I'm happy for the tenant to sign a new AST, I just don't want it to become a periodic tenancy.

            You do not need to issue an s21 then, just arrange for the tenant to sign a new lease.
