    Problems with landlord and girlfriend moving in

    Hi all,
    Short story in that my boyfriends uncle owns the house he lives in. They have a tenancy agreement and he pays a slightly reduced rent that was agreed 5yrs ago.
    The uncle/landlord does no repairs, he throws his weight around when it suits him telling us we cant service our cars on our own driveway and he hasnt done a gas safety check ever!
    So i moved in with my boyfriend in July. He told his uncle and he said he wanted me put on the tenancy. I wasnt keen as i would rather stay out of this weird agreement where he pays a reduced rent but the landlord does nothing. (This is no written anywhere but my boyfriend feels he cant ask for anything as the rent in lower than it should be)

    He sent me an email last week from a company who do tenant referencing... I clicked the link and he wants me to fill in a FULL tenant application.
    It wants me to put bank account numbers, balances, store cards etc and contact my work.
    I think this is intrusive and excessive considering this is his uncle!!
    I have said i dont want to be on the tenancy, i would not chose to rent this house and i dont want to fall out with u over not doing repairs so i want to stay out of it and im not happy to write my bank account numbers etc on the internet.
    I have offered to print off an experian report to give him but hes not happy and kicking off saying its illegal to live there and not be on the tenancy...
    Is this true? Ive had people live with me before, not on tenancy and landlord has known and was fine.

    He is saying he will kick me out with my 3yr old daughter! Just because i dont want to put my account numbers.

    Ive offered to do a short version of the reference thing but hes still not happy.

    Any advice?

    What is your issue with providing bank account numbers? No-one can do anything with those, apart from pay you money...

    I give my account and sort code to various people all the time... they're also in my tenancy agreements... it allows people to send me cash, I like it. They can't take cash from me with that information... I wouldn't like that.

    But, with it being November now, I would suggest you could just keep playing for time indefinitely... I mean, you moved in back in July... he's not really done anything yet, right?

      It isn't illegal to live there without a tenancy agreement.
      It may be forbidden by the tenancy agreement and the landlord could try and evict you both as a consequence.
      It may invalidate the landlord's insurance and put any mortgage at risk (BTL mortgages often have clauses requiring residents to be on the tenancy agreement).

      Never rent to or from family should be the slogan of this website.

        There's no such thing as a free lunch or a cheap rent without strings.

        Don't like it - then rent a proper place with all the frills, necessities (and price).

        Sounds like Uncle does not want you or daughter living there.

          I can fully understand and agree with you regarding the LL trying to avoid their repair obligations.

          Whilst there can be some issues with the LL having people living in a rented property who are not on a tenancy agreement these are their problems for choosing such products that dictate this.

          I would move.
          There is always scope for misinterpretation.

          If my posts can be interpreted in two ways, one that makes you feel angry and one that doesn't, I meant the latter.

          Everyday is an opportunity to learn something new.

            Completely agree, i would never rent off family and am working on my boyfriend to try and get him to move .
            In the meantime ive filled out the form but not put my bank balance or passport number on there, just hope he accepts that

                  Point out to landlord that not having e.g. gas safety cert, deposit protection, rent income - before expenses - declared to tax man. permission to let may become "painful" & would he like to re-consider: But pretty much guaranteed to have everyone evicted shortly.
                  I am legally unqualified: If you need to rely on advice check it with a suitable authority - eg a solicitor specialising in landlord/tenant law...

                    What about setting up a direct debit? For an organization that can set up direct debits that is.
