    Going From bad To Worse

    I used a local agent to find a tenant for my property all was well until they gave notice to move out the agency said they had a new tenant who dually moved in that's when the problems started within a couple of weeks problems first the boiler which I replaced as soon as I was made aware ,then a message from a neighbor can I contact the tenant about the state of the property
    I got a friend to go around to see what was going on im working away overseas ,he reported back that the previous tenant had made a right mess over 4K in damage but to make things worse the boiler installers had also made a right bodge job 3 K damage and the shower left disconnected
    The agency had no final inspection report had give the deposit back to the tenant's and then tried to say that it was like that when it was first rented even though I got proof it wasn't
    That's when the agency stopped replying to my e-mail I had told the new tenant that I would reduce the rent because the property wasn't perfect from 550 down to 200 she had paid the first months full rent to the agency but then the sob story started new bathroom new carpets need decorated ect at first I though ok ill sort out carpets and bathroom but then I asked her for payment and to sign a new contract with me then the stalling started she final paid 200 pound in her fifth month wont sign a contract with me and now is stalling to pay any more as she says the house is a mess but wont leave as she got now where to go she says she will move out in May but who knows she says its a mess but wont leave but I know its not as bad as she is making out most of it cosmetic and things missing or broken from the old tenant
    What redress have I got against the agency who wont speak to me about the damage done and wont even go to the property to view it or discuss it
    you try and do someone a favor and be fair and you get stuffed ive had enough even though one property has been tenanted for 8 year no problem the second one has been a night mare CCJ Bailiffs all to no avail still 4 K plus costs down and now this all caused by the agency in the first place
    Any had any dealing with the property redress scheme but looks like the agency are going to change names is it worth bothering with

      The OP is asking if any of us wishes to buy 2 properties near Oldham.

          Thanks for the clarification Hippo. Last time I went to Oldham, the judge told me to stop it and let go!!!

            Ok, some of the other posters have been a bit light hearted with you, but your post isn't easy to read and I'm sure the mod will remove your advert

            However, some simple feedback. Firstly, calm down - it's only business, that's why you have to be businesslike in your dealings with people.

            Now, with the boiler, if the agents employed the plumbers to supply/fit the boiler then that is their problem. If you can prove the work was substandard then you have a claim against the agent. You only need worry about the plumber if you employed / chose him. If the payment for the plumber went via the agency, then it is even more watertight. Is the agency a limited company or sole trader?

            If the tenant is behind on rent and/or has caused damage then that is between you and the tenant. You can not usually hold the agent liable for that, but assuming you are paying the agent, they should be helping you resolve the situation.
            Even if the tenant caused the damage, there are some things that you are legally obliged to repair (even if she isn't paying rent).

            It would sound like you need to evict this tenant. There is an FAQ sticky at the top of this section, answer the questions in there for us and you should get some help. Lack of maintenance can be a serious hindrance for eviction.

            Incidentally, as you are overseas, did you sort out your non-resident tax situation with HMRC?

                I don’t think you’ll get the property back by October either. The tenant is angling for social housing and the council will advise her to hand in until bailiffs physically removed her from the property.                 Looking at the news today (similar to yesterday and the day before), they are talking about combined energy bills of 4-5k a year...... by April 2023. There are many properties up north where the combined rental per annum is between 6-7k....... that is insane.

                I really can't see the new PM (who ever that is) is going to reach into their pockets to then give out more money, If they do I think it's going to be like the winter payment, only selected people will be eligible, and guess what LL's will not be one of them.

                I am trying to work out the best way to recoup some of the increase in the cost of the gas given that we can only put up the rent once a year but the cost is going to be increased in October and probably every 3 months.

                It's not possible to forsee how much prices will rise or what help...

                I doubt very much you will get the house back by October, the tenant has been told the usual by the local authority and will put up a fight, so do not count on your plans going....... to plan. In terms of the guarantor, its in the lap of the gods, if all tickity boo, then great but any flaws at all...

                One of my London HMO tenant's lodgers was kicked out by my tenant recently. She complained to me, so I suggested she move to Reading and could have one of my flats to herself for a similar payment. Not interested.
