    Tenant has abandoned flat

    Windows left open for a few week apparently. Curtains blowing in the wind. So I enter cos tenant could be dead for al I know. Fortunately not.
    No furniture in there. No bed. Place is empty. Getting foreign dialing tone when I ring his mobile. He not responding to voicemail text or email.
    ACT is in periodic phase
    Great so now am I supposed to serve two months notice to his email address or what ?
    Even though he's obviously gone.
    Is it worth the rik of simply re letting it. Otherwise I'l know I'll lose two or more months rent if I follow the non commonsensicle legal process.

    Why would you need to send a 2 month notice to their email address? What's wrong with the notice you hand delivered 5 weeks ago?

      Where did I say I delivered a notice 5 months ago ?!
      Or are you hinting I could say I delivered one there sometime ago when he was gone ?

        Could be on holiday in foreign & returning with new furniture.
        I am legally unqualified: If you need to rely on advice check it with a suitable authority - eg a solicitor specialising in landlord/tenant law...

              Follow the correct legal steps to get a possession order or plough ahead and take possession of your property back illegally and hope they don't return from their extended vacation and pursue for illegal eviction. When did they last pay rent?

                  It's not overly bizarre. It's where you would have served it regardless. Their home. It's not up to you to ensure that they've read it. They don't have to sign and return anything to you.

                      You can say, and claim what ever you like. The problem is that once you start making false claims to circumvent the law, especially where you are not aware of the all the facts, it is easy to get caught out. Of course you might get away with it.

                        What are the relevant dates for this tenancy? 10 days ago didn't happen to be the end of the fixed term by any chance? Are you holding a deposit?

                          I will remind people here of the forum rules regarding illegal activity and suggesting that people make fraudulent claims about notices, no more please.

                          I will also point out that this is a public forum, the tenants in question may be reading this thread and capable of working out that it is about them, that happens more often than you might think. If they were to make a request for information from LLZ for legal purposes, then that data will most likely be provided to them.

                              Serve notice of an inspection in 24 hours to review the condition of the property, turn up, shout loudly and let yourself in (ideally with a witness).
                              Secure the windows and sort out the place generally (possibly leave the notice to quit pinned somewhere obvious).

                              Wait the two months and repossess.
                              When I post, I am expressing an opinion - feel free to disagree, I have been wrong before.
