    Booking License Eviction

    Hi

    How can i evict someone who is on a booking license?

    The local council housed someone on a booking license

    They are paying me a nightly rate

    The tenant is causing me lots of trouble, being anti social

    I've asked the council to move him but they can't and have ask me to evict him

    How do i evict someone on a license?

      Is the council or you named as landlord on licence? Do you have the original?

      Normally council evict in such circumstances, don't understand.

      What contract do you have with Council, how much do they pay you per day, when did you start taking such persons?

        It's my name named on there
        I'ts emergency housing, nightly lets
        I don't have an official contract with the council
        They called me one day and asked if i could house a few of their tenants
        They pay me monthly, i send them an invoice with the daily rate on there ie. 30 days times £30pn
        I did my own nightly let hotel style booking form
        Can i assume i can't use the n5b s21 route?
        How do hotels evict their tenants i wonder? It's a similar scenario

          Do you live in the same building? Hotels do have licenses but circumstances are different Or are you providing Hotel-like services (room service, meals in dining rooms..) & do you have other "hotel" guests?

          If you send invoice & they pay you do have a contract, but not written.

          Talk to the council department you deal with.

            No i don't offer those services
            Just accommodation
            No i don't have a contract with them, they just pay consistently, within 10 days of invoicing in fact - there are never rent arrears so i'm happy
            They are refusing to deal with the eviction - they told me to deal with it
            I've read someone about serving a 14 day notice on the tenant - what could i do here?

              I repeat, do you live in the same building? Please answer, this is key.

              If so do you share facilities -kitchen, bathroom etc?

                  I know I'm old & slow but if you are a non-resident landlord, the property is a self-contained flat, you are named as landlord, why should any judge conclude it is not an AST - regardless of what the paperwork says?? Unless the paperwork was from the council granting a licence along these lines??

                  Who supplied the licence/tenancy agreement you signed with the occupant??

                  When you spoke with council housing people you deal with, what did they tell you about your rights, the legal tenancy/licence etc etc??

                  You can ask him to go: He may go: But if he doesn't....

                  How many "self-contained flats" in the building & how many from the council??

                  Are you a member of a landlord association?? Tried their helpline??

                  Run this pretending to be tenant & see what you get...
