    Joint rental agreement, 1 signed, 1 hasn't yet - is it a binding agreement?

    We are about to sign for a joint rental of a property with Romans. The electronic documents came through - my partner has signed it, but I haven't yet. Only the holding deposit (£500) has changed hands.

    Just after my partner signed it, she received an email that a shared ownership house that we were originally trying for (and lost out to another buyer on) has come back on the market. We would much rather go down the shared ownership route.

    My question: If she has e-signed the document, but I haven't, is it a binding document? Can we back out? Is there a cooling off period?

    I suspect under the "Distance selling regulations" she has 7 (or is it 14..??) days to cancel..

    You need here to distinguish between a contract (she HAS signed one, albeit electronically..) and the tenancy (which does not start until you move in..).,

    Since a tenancy for less than 3 years need to be written at all who did or did not sign is not always the decider.

    Suggest you/she negotiate with agency, quoting "Distance selling regulations" & try & get out.. of the CONTRACT.

    I am legally unqualified: If you need to rely on advice check it with a suitable authority - eg a solicitor specialising in landlord/tenant law...
