  • References for prospective tenants

    We have a property for letting. It has been up for a couple of weeks. Had a few viewings but it seems that only the dss applicants have been returning the forms. Where and what is the best place to go to reference these applicants as most of the referencing sites are for credit checks which will not be required as the rent will be paid by the council.

    uh? Credit checks are still very advisable even if the council are paying the rent - your tenants may have been registered bankrupt, have dozens of CCJ's to their name - would you still be happy to let to them??

    If you are still happy to let to them, do a full credit reference on them, take a Guarantor also if you can.

      I agree. The Council might in practice pay rent direct but the obligaion rests on T in person; you could never sue the Council, could you?

        What if the tenants tell the council to pay the rent direct to them, and they decide to spend it all on fags, booze and the gee gees? Moreover, if they withdraw their consent (if they gave it in the first place) for the council to talk to you about the claim, what will you do? What if they then "forget" to send in some form or other and their claim gets suspended - how will you know?

        Although a generality, HB tenants usually require more time input from landlords - maybe because they tend to have a socially disadvantaged background and are used to things being done for them. We have some really thick tenants on HB, and quite often we fill in the forms for them in the office and keep copies - there are less mistakes that way.

        See if you can call on them where they are at the moment - maybe to pick up or see ID or a form. This a very good way of seeing how they live.
        On some things I am very knowledgeable, on other things I am stupid. Trouble is, sometimes I discover that the former is the latter or vice versa, and I don't know this until later - maybe even much later.           I wasn't aware that the identity of council tax payers was a public record. You might be able to get a statement that it wasn't you. without breaching the Data Protection Act.

          Why must we continuously renew our deposit with the scheme each time we re-sign our AST i.e. every 12 months?

          Why can the deposit not remain protected throughout the duration of the overall tenant occupation?

          Is our landlord acting in questionable faith by asking us to pay...

          The main problem I have for the charge being passed on is that often times (esp. through agents) the charge is actually considerably more than the protection fee they pay the schemes. It's been used as another way for agents (or landlords) to make money.

          Your still confusing your own council tax liability at your current address with that of the rental property.

          If no-one was registered as living there then you would have been billed as landlord. The fact that you haven't been indicates that they are aware of who was tenant. ASK THEM FOR...

          To be fair lvkn yes the rent covers everything you state, but the 48 pound charge Is your choice and is avoidable.

          You choose to use an insurance based scheme and hold the tenants money collecting interest. How is it fair to force that charge on your tenant each time?

          If you have no ongoing contract with the agent and it was "find" only, they have no right to force you into a new AST.

          Depending on the terms of your contract there's nothing to prevent you, if your feeling confident, in renewing the contract yourself and taking over.
