    Tenants Past History

    Hi guys

    After many weeks I thought I would post my question as you seem like a pretty friendly bunch.

    My question is can a potential tenant hide an eviction from a previous property either LA or Private?

    I have a potential tenant who I have been advised by several people that he has a history of being evicted and property damage.

    I am not keen to let the property to him but every time it put up a hurdle he climbs it ie: larger deposit,guarantor, but I know he hasn't got the best reputation and I would rather have an empty property than a bad tenant-so would a credit search show the evictions? Or are they on a database for example ?

    What's stopping him hiding his address history to not show the evictions ? And what do I do to make sure he can't hide this?


    I would rather turn him down this way than just say "no" as I don't think he would take that very well and am a little scared of his reaction.

    What I think it comes down to is that the best policy has to be to avoid a tenant who looks like he may cause you problems. There are three possibilities:

    (a) a tenant who causes no problems

    (b) a tenant who causes problems which may be covered by a large deposit or guarantor

    (c) a tenant who causes problems which are not covered by a large deposit or guarantor.

    Whilst (b) has to be better than (c) it is still better avoided where there is a possibility of (a).

      If you are scared of him involve the Police: Golden rule in business: If uncomfortable doing business with anyone (in your case letting a property), don't. End of.
      I am legally unqualified: If you need to rely on advice check it with a suitable authority - eg a solicitor specialising in landlord/tenant law...

        thanks for your reply Lawcruncher but ideally for future reference I would like to know "-so would a credit search show the evictions? Or are they on a database for example that would show a evictions" ?

          Evictions are not recorded AFAIK and T does not have to reveal unless asked a specific Q.
          Have you fully ref''d the T and contacted previous LL direct?
          If you don't trust T, just say No. - a business decision.

            A credit search shows CCJ's, bankruptcies etc.

            You should ask your tenant for the name and address of his last 3 landlords for reference purposes. Then you should personally check that the addresses and landlords are true.

            If he is hiding, you won't get real landlords or addresses.

              Mia123 - if this prospective Tenant jumps all the hurdles and you find nothing untoward about them and you're still not happy letting to them, what do you do then?

              I would bite the bullet now.

              Tell the prospective Tenant you've agreed to let the property to someone else. This is a little white lie at this current moment in time. You need offer no further explanation or any more detail. Do you suspect the Tenant won't take no for an answer? If someone told me a property had been let to someone else, I'd just move on, and recommence my search... do you fear this Tenant won't behave like that?

              Bring an end to this right now if you can.

                Hi guys thanks for replies.
                Hippo I have actually withdrawn the property and told the LA that it needs work and advised them to advise the prospective tenant hopefully he should if heard by now.

                Fingers crossed I won't get the several calls a day I get from this angry man - I have no idea how he got my number!

                I was advised by a close family member who works for the force that he had a very chequered history.

                But on the referencing the eviction didn't show and I don't understand why ? And it had taken several people to advise me of the past evictions and property damage so lucky escape but what this site had taught me is get to know everything and then you don't get surprised.

                When I asked the agent why they didn't pick this up they couldn't give me a answer.

                I will use 192 as advised anyone recommend any others ? Or any companies who provide such services ?

                  It sounds as if you commissioned an agent to get the referencing done on this undesirable. Do you know what the referencing consisted of? It may just have been a credit check, which is not enough.
                  Were you shown a copy of the references? (you should have been if you'd asked).

                  Plenty of companies will do proper referencing: some advertise on this site, some are available through Landlord Associations. (I can see an ad on the site now).

                    I've just found out some things about a T who has done a runner owing a small amount of money.

                    I typed in his name and it came up on facebook . Not a lot of onfo from that.

                    I googled his name and found out he used to be a company director and the co was dissolved with an outstanding debt.

                    I also found out that he had been involved in a rather large drugs haul several years ago.

                    None of this came up in the search I paid an agency to do.

                    I have found that 192 isn't very good but is a place to start.


                    I've used peopletracer.co.uk £9.54 for 6 searches to be used in 6 months. Couldn't find him on this.

                    There are loads of tracing agecncies if the google the term, but I've not found a good one yet.

                    Let us know if you find a good referencing agency.
