    Thanks guys,

    Yes she will be going to the hearing on thursday.

    So if lets say for example the court agrees to 10 weeks of £43.50 on top of the £91 rent, and these are paid correctly and on time would the possession order be finished and void?

    If perhaps she fell into arrears again in a year or so could she still be evicted using the same possession order?

    Also would the ccj be removed from her credit file if all payments are made correctly and on time.

      I am legally unqualified: If you need to rely on advice check it with a suitable authority - eg a solicitor specialising in landlord/tenant law...

        Depends on the conditions of the order, usually one will be that the tenant keeps up with ongoing payments. That means if she falls into arrears again the LL can go back to court and get possession quickly without needing to serve a new notice etc.

        I imagine you can ask for the CCJ to be recorded as satisfied (£15 I think), once the arrears are cleared. But once its on the credit file it stays there for 6 years unless it's later set-aside.

          So my friend was a nervous wreck this morning. Had her hearing at 12.30 and called me to tell me its been adjourned (as the arrears are so little) for 2 months as to give her a chance to pay off the arrears without a possession order.

          She said she was excuse my french "Shitting herself" but the judge made her feel at ease.

          He even asked if she wanted to pay less per week off the arrears!

          Just one more question. Does this mean she has no ccj because no possession order was given?

          Thanks for your help guys. Just thought you would like to know the outcome.

            No judgement has been made, so no County Court Judgement has been made.

            She should get some paperwork in a few days, so go and have a look at them.
            Allow tenants to protect their own deposits. I want free money when they do it wrong

              Sorry but I must reitterate that she DID provide all documents which were initially requested before both parties signed the lease. This new, rigid requirement for a utility bill only came a day before the agreed move-in date.

              This is not a case of a prospective tenant having no paper trail....

              When you put it like that I'm more inclined to edge towards the S21 route regardless. As much as part of me feels some compassion for the guy and doesn't want to lump more stress on top of someone who appears to be struggling already, as has been said before, none of us are acting as a charity.
