TDS Question Resident Landlord

I have registered with the free DPS, my question is I'm sure I read somewhere one exception was resident landlords did I imagine it ? as I can find no reference anywhere now.

Silly me forgot log in name and had to register again.

Resident L means not an AST so TDS n/a.

jeffrey, thanks for your reply, please could you expand more, I have converted bunaglow divided into 5 flats, I live in one, am I classed as a resident landlord and should not be using AST's ?, 3 flats (inc mine) have shared access, other 2 have separate independent access.

If not AST what should I be using ?

Is each flat self-contained with it's own bathroom & kitchen? Is the only shared facility the access? If the answer to these two questions is yes, then you can use AST's.

Yes, Joannepowell, shared access plus all have access to the Washing machine, all have own kit/bathroom etc, does this mean I'm not a resident landlord, its very confusing as I've searched, even the links I have followed state its not clear cut

You are definitely a resident landlord - tenancy deposit scheme does not apply unless you use ASTs (inadvisable anyway as there are some shared facilities). Use a licence agreement for each occupant and you can take and hold a deposit without fear or favour.

Thankyou Paul_f, for your advice, been using AST's for 11 years, you live and learn, off to read up on licence agreements
