    Awaiting warrant for eviction under S8 - do I still need to serve S21?

    I have a possession order awarded to me by the court under section 8. I am awaiting a warrant for eviction because the tenants had still not moved out at the date of vacant possession. As you all know, the process is glacially slow. By the time the warrant is granted the 12 month AST (end of July) is likely to have expired. Does this mean it will turn into a periodic tenancy, and will this affect my ability to evict the tenants? Should I also serve a Section 21 notice now? Maybe this is a silly question but I've thwarted by legal complications at every turn during this process! Any advice would be appreciated.

    PO remains valid during periodic:

    You might wish to issue S21 anyway as the tenant can (well, some have successfully in the past..) still appeal for suspension/cancellation of S8 PO on disrepair or other grounds: Then you'd have another eviction route if that gets bogged down.

    However hopefully tenants will depart quietly...
    I am legally unqualified: If you need to rely on advice check it with a suitable authority - eg a solicitor specialising in landlord/tenant law...

      If you are waiting on the warrant, I see no point in serving a Sec 21 myself.
      It will be done before July. You usually find out the eviction date within a week of two of applying.
      Allow tenants to protect their own deposits. I want free money when they do it wrong
