    I have recently looked at a property with a view to buy and noticed that the master bedroom bay window does not have an opener. All other on the same floor have openers just not the master.

    Is it a legal requirement that all bedrooms on the same floor have windows that open?

    If this is a period property, then there is no requirement to change a non-opening window to one which opens.

    If it's of fairly recent construction, then the requirement will be whatever the building regs were at the time of construction.

      Sorry I wasnt very clear I mean for letting purposes. If I decide to let the property do I have to ensure that the master bedroom window can open?

        No you don't but I think building reg require a certain amount of fresh air. Provided by either an opening window of a proportion of the floorsize or a ventilator.

        Somebody more qualified can confirm this or check building regs, or ask your council.

          Double glazed bay windows are notoriously expensive as some take up to 7 units. A way of saving on the cost was to not have openers.

          Today, building regs insist that the cill height is at a level one can get out of and that there must be a casement window(s)on upper floors to aid escape in case of fire.

          As an aside, I noticed in footage of the front of the Philpot house where 6 children died by fire the upstairs windows only had top openers and no casement openers. There may have been a happier ending if escape could have made via a casement.

            Does it have "trickle vents" also?? You really want openers and/or trickle vents... tenants & condensation/mould is a common problem and having good easy ventilation is a wise precaution.. not to mention Interlaken's wise comments...

            I am legally unqualified: If you need to rely on advice check it with a suitable authority - eg a solicitor specialising in landlord/tenant law...

              the rules relating to double glazing are covered by FENSA and building regs - when replacing windows the rules are NOT to make any situations worse than they were originally (which helps with buildings in conservation areas etc) so if they only had top openers then so long as the opening itself is no smaller than the original then they are ok. If I was really concerned about the occupants I would make sure I had a decent fire alarm system - over and above the one required and even poss domestic sprinklers!!!

              of course openers do more than provide means of escape, they provide ventilation to prevent condensation and to allow air changes for smells etc!!

                  The Tenant Fees Act doesn't impact a landlord (or tenant) being able to sue for compensation for a loss.

                  I'm not sure what loss the landlord might incur if the tenant did decline an inspection, but, for example, if the landlord had paid for someone to inspect the property and the tenant...

                  Indeed, the contact makes a provision to allow inspections, however, does not specify that the landlord may sue for financial compensation in the event that I refuse one. Would a landlord be brave enough to even insert a clause for monetary compensation or even attempt to sue given the Tenant Fee Act...

                  I think that knowing I was responsible for the energy used from the date I moved in I would not just have accepted that no-one knows where the mater cupboard key is. I would have got it open somehow. The ones in my flats can be opened with a flathead screwdriver....

                  As Artful says, the tenants notice is invalid as its served during the fixed term, (unless you have a contractual periodic tenancy), so you can't legally rely on them moving out and would have no recourse if the changed their minds and stayed on.
