  • Tenant walked away leaving all possessions.

    Our tenant has left the property leaving all furniture and possessions. She is in arrears with us and has other debts we have found out. Neighbours have not seen her for over two weeks. We have changed door locks because someone has broken in and changed the back door lock themselves. Police and Social Services have been informed as tenant had a young child. We have no forwarding address. How long must we wait before organising a house clearance? Are we liable for storing all her possessions so that we can re decorate and re-let the property? Any advice and timings would be appreciated.

    What does your tenancy agreement say about abandoned property/left belongings?
    Allow tenants to protect their own deposits. I want free money when they do it wrong

      Why do you say she's left? If she turns up out of the blue tomorrow and runs to the police screaming "illegal eviction - I've just been to stay with a friend" (an offence which carries a penalty of massive fines and potentially even prison), how will you respond?

          Or in hospital, emergency, family crisis miles away, arrested on remand about to be released Innocent... careful, careful....
          I am legally unqualified: If you need to rely on advice check it with a suitable authority - eg a solicitor specialising in landlord/tenant law...

            The tenants tenancy remains valid until she either surrenders it to you or you obtain a court posession order. What efforts have you made to contact the tenant? Is tenants rent paid direct to you by Housing Benefit?

              Be very careful law is on side of tenant.

              Try as hard as you can to track her down before doing anything.

              You could take an absolute flyer and put the lot in a skip as many landlords I know have done however whilst it may be unlikely if the tenant turns up you are very exposed. Landlord law has a few good articles on this point.

                Without wishing to sound rude, you don't sound at all competent to head this off without help.

                I'd recommend you instruct a good solicitor specialising in property to deal with this on your behalf.

                Get a new GSC arranged. A valid GSC is a requirement during any Tenancy..
                T does not have to vacate on expiry of Repo Notice, she could remain your T until legally evicted by Court Bailiffs after a further several weeks/months.
                For ~£50 (tax deductible), is it worth the risk?

                Sounds like the guy who contacted you was your tenant's lodger, doesn't it? Therefore it's up to tenant whether to return deposit or not. (Sounds like room was left in a bad state.)
