  • Charging for damages - (newbie in lettings)

    Hi,

    I have rented my flat out and the first person who had it left it in a bit of a mess

    From what I can gather, clothes have been dried indoors, without any form of ventalation and mould/mildew has grown everywhere. Imagine on most of the walls and ceilings.

    Also, imagine a flat rented out for 6 months and no sign of it ever being cleaned. The carpeted areas were covered in fluff and the wooden floors felt crunchy to walk on. No sign of cleaning Sinks, toilet, shower, oven etc.

    Finally a couple of units, curtains, blinds etc have been damaged by mould and high humidity.

    Now what can I reclaim from the deposit?
    Can I claim my time for removing mould and cleaning (around 11 hours)? and at what rate? (£20 per hour?)
    Can I claim fuel to and from the property? (have made two trips - approx 80 miles - if so, at what rate can I claim? also travelling time)
    For damaged items, I intend to claim for 90% of the value(all two years old, expect to last 20 years?).

    Is this reasonable? (I don't wish to sound greedy and I would like everything done correctly.)

    Did you conduct an inventory/condition report at check-in?

    Is the T disputing liability?

    Assuming this is an AST, is the deposit protected in a scheme?

      Was the deposit protected?? Have you advised the scheme of your intentions??

      Was there an agreed (eg signed, dated by tenant) moving in inventory with full, detailed, descriptions and photos?? Ditto move-out?? If so you've a chance: If not forget it, you'll likely lose any adjudication.

      20 year life for carpets, wooden floors, anything else damaged?? Some might say that that view of 20 years is very over-optimistic & would be "betterment" & unlawful.

      Did you get estimates from cleaning companies for removing mould??

      Were there any inspection reports during the tenancy?? What did they say about cleaning & conditions??
      I am legally unqualified: If you need to rely on advice check it with a suitable authority - eg a solicitor specialising in landlord/tenant law...

        Yes

        Not sure yet, want to make sure I get all the charges correct first.

        Yes, it is in DPS scheme.

        Yes, for moving in.

        I am not charging for carpets or wooden floors, these were all cleanable.
        Is 20 years too much for curtains, blinds and wooden furniture?
