    Deposit protection


    New to this forum......

    I rented a residential property in 2009 and did not put the deposit into deposit protection scheme.

    It's still the same tenant but I wish to put their deposit into protection scheme now.

    Can I still do that and if so,any implications of doing this late?

    If the tenancy is an Assured Shorthold Tenancy in England/Wales, then your failure to protect the deposit (and to provide the prescribed information) means that you are exposed to a non-compliance claim by the tenant under s.214 Housing Act 2004. Protecting it late doesn't get you off the hook.

    Also, if you wish to serve a s.21 notice on the tenant, you will have to return the deposit before you may serve a valid s.21 notice.


      Why do you wish to protect the deposit at this late stage?
      Allow tenants to protect their own deposits. I want free money when they do it wrong
