    Can I sue my landlord for breach of contract?

    Hi

    In July I moved into a brand new rented 3 bed house. Because it was still being built I could only view the show home & outside.

    I paid extra because the house had an ensuite. The spec states that in the main bathroom there should also be a shower but there isn't. Since the day I moved in I have been fighting for this & getting nowhere! It's ridiculous because I paid extra so that on the mornings we wouldnt all be fighting over 1 shower which is in my bedroom! I had friends stay over last week & they too had to shower in my bedroom.

    I could rent a 3 bed with 1 bathroom for £125-£175 a month less!! Yes not brand new but actually slightly better area so car insurance cheaper too!

    I don't really want to move but I'm at the end of my teather. So if I do govthis route does thus constitute breech of contract? Can I ask for compensation for moving costs, money spent having people in to hang pictures etc? Sheer inconvenience? How do I start this proces? Do I need a solicitor?

    Do you have any proof of what was promised, that wasnt delivered?

    When does your fixed term expire?

      Actual contract doesnt go into that level of specifics

      Yes- I have the builders spec given to me by the agents which states the shower should be included and also I have an email and text converastion where they agree to fit the shower and make arrangements for a plumber to visit. He does actually come round but then nothing!
      When does your fixed term expire?
      Fixed term July but they have said if Im not happy I can leave now!

        You could sue, but I doubt it's worth it. I doubt you would get moving expenses, as you shouldn't have moved in the first place if the tenancy was dependant on having a shower.

        What date did they say that you could leave? Is that without penalty?


        Have you had a plumber come in and priced up for fitting a shower?

        You should have asked your friends to use the bath, it wasn't essential that they showered in your "bedroom".
        Allow tenants to protect their own deposits. I want free money when they do it wrong

          did you actually sign the contract before viewing the house?

          I think it would be difficult to sue for the absense of a shower. Not sure how a judge would see such a case. I think that best case scenario is that the landlord would give you an amount towards your move, as a gesture of good will and that is not very likely.

          Compensation for the inconvenience, i'd say impossible.

          I think you should also be happy if they are letting you move out without a penalty. If the landlord said he doesnt care, you would have to stay for the entire fixed term. I think suing is rather hopeless

            Guess I've been very lucky this time. My niece has informed her partner that she is ending the tenancy and signing up for a new one in her name only and he is ok with it. She did point out that he will no longer be responsible for any more rent or bills when it's totally in her name.

            Good evening all,

            I wonder if I could get some advice on ending an AST tenancy in England.

            Originally a 6 month AST last Sept between my niece and her partner, I foolishly listed both on the AST as joint tenants and didn't list him as a permitted, there was no deposit paid....

            There may be something on the NRLA website, but I don't know of a standard template.

            To be honest that clause doesn't seem to help you a lot, it stops you using a s13 notice (I'd wrongly assumed that because it said "may" you'd be able to) but doesn't actually help you with an...

            “The landlord may increase the rent after the first 52 weeks of the tenancy…..”
            Is there a specific form I should use?...

            Thanks jpkeates, I looked at the form 13 but that’s for if you don’t have anything in your tenancy agreement with regard to a rent increase. Is there a pro forma for a rent increase if there is a condition in your TA?

            If the tenancy is now an SPT, and you want to be ever so formal (and impose the increase without any agreement), search for form 13 (which is called something else on the government's tenancy forms page).

            Otherwise, you just need to get the tenant to agree and start paying the new rent...

            It is quite likely that the 2 additional months might be seen as a deposit, unless the tenancy agreement is very specific about the initial payment being for months 1, 5 and 6.

            If it is a deposit, you won't be able to use a s21 notice without returning it and the deposit will be unlawful...

            Hi All,

            I have recently had new tenants move in.
            the estate agent did the whole thing and put them in.

            The arrangement with rent payments was this. 6 months AST Tennants pay last 3 months rent in advance and then make 3 monthly payments in advance. Ie start of the month....

            BUT to answer your question, yes the 3 months very much look like an unlawful deposit, being for a non-defined period (the last 3 months of a tenancy). If it is for a specific 3 months, its a bit lesss grey but then I'm wondering what you hope to achieve...
