    Tenant Seeking Landlord Advice For Damage Costs

    Hello,

    I'm new here and I'm looking for some serious advice/opinion from landlords on here. I am a tenant living in Manchester with one other, we are both full time and hardly at home. This letting agency I'm with is being very difficult at the minute, saying we have to pay for damages that we have been telling them all year throughout our tenancy.

    Before we moved in, on our viewing day, there were brown leak patches on ceiling and mould in the 2 bathrooms and I asked if these were going to be fixed and they promised it would but when we moved in, nothing was fixed. So I handed the inventory in, as specific as I could and ask them if they can fix these asap and the said within the next week. A week went by and no one got back to me, so I popped into their office, they said the same thing as before but no one came.

    So, there were continuous leaks throughout the flat from when I moved in and still ongoing. All they said is don't use the upstairs bathroom, so I didn't. 3 weeks later no one came to fix it.

    So this is the same over and over again, throughout my tenancy. I called and no one came. Maintenance came once or twice and said they'll come back but still never did. Now the leak from upstairs is so bad it created a huge whole in the bottom bathroom (through the brown patch mentioned earlier). They told me not to use it until they got a quote, 6 weeks later, no one called us and we have to email them and they said 'You will pay £900', so we said no, we're not as we tried to called them to get people over all year but no one did. The damage was a crack on the shower tray which was clearly patched over if you look closely at it and they said they were disappoint that this wasn't told to them sooner.

    I just went to see the lettings agent today and they said we have no proof in writing that this was mentioned, even though I have all my mobile statements saying we called them to come over all year. They just kept saying you have no proof, so you can't prove anything.

    This is not our fault and we are not giving up easily.

    Please, please please give us some advice? Should I get the landlords address? if so, what should I say?

    Also, There's still damages occurring in the flat, so should I email the lettings to get it fixed asap. I have been taken pictures of damages recently.

    Suggest you immediately edit (if you still can..) your post to remove agent's name. Against forum rules, danger of YOU being sued by agent etc...

    I am legally unqualified: If you need to rely on advice check it with a suitable authority - eg a solicitor specialising in landlord/tenant law...

        So when you returned the inventory, did you include mention of the patches?

        I'm not defending the inactivity of the agent in failing to attend to the problem; however it sounds as if you continued to use the leaking upstairs bathroom despite being told not to, and despite apparently having a second bathroom available in the property. Is that correct?

          Yes I did put the brown patches in the inventory and after the first leak, they told me it's okay to use it after 3 weeks of non use and then it started leaking again, so I rang them but they never sent anyone over. I remember when the maintenance came for the first time, I specifically pointed the brown patch out to them and they said we'll come back for that in a few days, but they never did. The brown patch just kept falling off over time and eventually it just came off when I was in the shower (downstairs).
