    Sitting tenant??

    Hello,
    I am looking for some advice regarding a sitting tenant. My dad purchased a property from a charity who had received the property after the death of the previous owner. The property was purchased with a tenant in it however I have checked and she is not registered as a sitting tenant.
    I made some enquiries and was told that it was actually the current tenants husband who was living at the property whilst she was living elsewhere. When he passed away she moved in however I have reason to suspect that she still lives elsewhere. She is never in and I believe she only goes there to collect mail.

    She actually told me that she used to “visit” her husband whilst "he" was living there!

    Is she therefore a “sitting tenant” and what is the best way to proceed with this?

    Does it show the details of the husband or wife at all ? please dont post any personal details.

    She could have used succession rights http://england.shelter.org.uk/get_ad...cession_rights

    Is the Rent up-to-date ?

      I put the postcode into the search and nothing for the property comes up.

      I don’t know when the husband first moved in.

      She is not up to date with her rent (4-5 months behind)

          Date moved in is key. Have you any knowledge about when?
          I am legally unqualified: If you need to rely on advice check it with a suitable authority - eg a solicitor specialising in landlord/tenant law...

            The question is whether she is a Rent Act/regulated tenant (not a 'sitting tenant'). No-one on this forum can advise on the basis of such sketchy information. Go to see a lawyer; ideally, ask a public access barrister who is specialist in landlord and tenant law. You can find one here: http://www.barcouncil.org.uk/about-t...ess-directory/

            It will cost a few hundred quid but it'll be worth it to establish the tenancy status of this woman.
