    Tenants Posessions

    Hi All,

    Just a quick one I need clearing up - we have had a tenant vacate a property, giving the correct notice etc. Tenancy end date was 16/01/2012. We now have had two failed attempts at meeting with the previous tenant to hand keys back and complete a property inspection to decide on the refunding of the deposit money. Ex tenant is playing games when it comes to meeting us with keys, so as the tenancy has ended and the tenant has moved out, we have entered the property and changed the locks. Just before the tenant moved out, he called me to say that he was moving into a much smaller house, and asked if we wanted to purchase some of his furniture to let the property as furnished? I politely advised no, and I am fully aware of the state of the furniture, however, T has moved out and just left the unwanted furniture in situe. Where do we legally stand in terms of throwing it away?

    Kinda depends what the Landlord's tenancy contract with the ex-(?)-tenant says..

    A really devious tenant with a cunning lawyer could try to make a case that as keys not given back & possessions there (and your confirming this in this thread..) then the tenancy has not ended and we're in unlawful, criminal, eviction territory.. Hope not!!

    I am legally unqualified: If you need to rely on advice check it with a suitable authority - eg a solicitor specialising in landlord/tenant law...
