  • Rent Appeal Assured Tenant

    Can an assured tenant appeal their rent to an evaluating panel if they have been paying a higher rate for 2 years and signed that they were willing to pay that sum?

    Basiclly is the Rent appeal procedure there for before a raise is agreed or can it be used even after the tenants agreed to a certain rent and now want to lower it?

        Normally T has recourse to RAC to challenge latest VOA assessment determination of rent, but prob not after paying the registered rent for 2 years. If LL has requested an increase to registered rent after 1.75 years, T is allowed to challenge and RAC may determine a rent below that proposed, for a variety of reasons.
        I think we need more detailed info from OP

          Any previous AST they may have signed wouldn't be worth the paper it was wrote on

          Mariner,that's is mainly for tenants moved in before 15th Jan 1989..(RT)

          Assured tenancy are dealt with differently,which RCA would be able to advise the OP on.

          Agreed however we do need More details from the OP ! and sticking to one thread and not running 3 threads would be helpfully....

            Thanks for your input. I opened 3 threads because all three deal with unconnected aspects. I thought this would be sensible to help future users who need advice on the specific issue.

              More details.

              The council have been paying on behalf of the tenants £200 per week for last 2/3 years to previous landlord.

              The current market rent is around £180.

              I am trying to establish what would happen if for example the areas rent or the council benefits were drasticly cut to £100 would the tenants be able to apply for a rental review even if they have been paying this for so long and they signed that they agree to this rent? I actually had them sign a letter confirming that they agree that the rent is £200 p/w - I did this because I didnt want to ever have to rely on the false AST to prove any agreements.

                    If your referring to government cuts in housing benefits ? not to sure about that !
