    New s21 for April 2012 hearing?

    Good evening

    I've tried to evict a tenant.

    But i didnt have proof of serving the s21.

    There's a hearing in April 2012 (long delays nowadays).

    Could I serve a new S21 expiring in over 2 months, with proof of receipt and use this one at the hearing?

    Or will the judge insist that a new eviction should have started, as on the n5b form, we have the old s21 dates on there.

    You have to give 2 months notice before you can commence court proceedings. An s21 issued now can not be served 2 months before a case thats already started!

    I would serve a new s21 in case this hearing fails, but you may be able to submit a statement as proof of service - It has worked in the past but no guarantees.

      Can i wait for that hearing in April

      And start a new eviction after the new section 21 expires

      So in affect have two evictions running at the same address for the same person? (just in case the April hearing goes against me)

        You don't need proof of receipt, you need proof of service.

        You won't be able to use new paperwork with an old claim, but Snorkerz has given you advice as to what to do at the current hearing.
        Allow tenants to protect their own deposits. I want free money when they do it wrong

          The work that they do would effectively be rent.
          But the letting rules for agricultural workers are different - but that's about the extent of my knowledge.

          Unless you've always wanted to be a landlord, I'd sell them and use the money to do something different.

          Being a landlord at some distance is not easy, and being a landlord isn't all gravy either.
          It's not something to do just because an opportunity comes up.

          Sell them.

          As a 40% tax payer you will be hit hard by tax; managing properties from afar is difficult and expensive; as IHT will have been paid there will be no CGT if you sell quickly; land lording is not something you can learn overnight & there are a multitude of pitfalls.

          Thanks everyone. I will take your advice and not bother. The mobile home is on my property and the door is about 10ft away from my door but it has shower, toilet etc. I really don't think it's worth all the bother especially as I have an extremely difficult neighbour who would report me at the drop...
