  • section 21 what else too late?

    Hi if a tenant was been served with a section 21 notice and file is going before the court for a possession hearing in the next week or so can anything be done at the same time about the last two months rent she didn't or isn't paying since receiving the notice. What is the best way to go forward, she receives HB as well and think she has kept it.

    Are you having HB paid directly to you?

    Are you sure there will be a hearing for the s21? That isn't usual. Do you know why?

      No sorry file should go before court shouldn't need to be a hearing only a day or so left for her to contest it. She hasn't ever missed a payment until notice served. So now she is two/three months in arrears. But I didn't want any problems with section 21 by doing something else.

        A S.21 Notice has no connection with rent arrears, and will just allow you to obtain a Possession Order if your paperwork is in order. S.8 Grounds 8, 10 & 11 is the one for unpaid rent.

          Hi yes thanks I understand that, but what would be the best way to sort out the arrears would it be to wait until possession is sorted they try small claims?

            Yes you won't know extent of T rent liability until evicted.
