  • Unresponsive T, gas check due? Advice please...

    Good evening all,

    We have a tenant in a house who until this point has paid the rent either on the 1st or within a day or so. However this month the telephone number I have doesn't ring and the rent is late, they have also without permission erected a metal security gate over the front door.

    Added to this is that the gas check is due next week.

    I've written to the T (last Thursday) but had no reply, knocked on the door today but no answer (despite car in drive, all curtains closed).

    What would youre advice be please? I'm not planning on breaking in to get the gas check done but what can I do if the T isnt responding? Could also do with the rent lol!

    Have proof by the way of proof of posting(free from Post Office) of your repeated attempts to get the check done.

    Serve a valid Section 21 notice to get your property back.
    Allow tenants to protect their own deposits. I want free money when they do it wrong

      I am legally unqualified: If you need to rely on advice check it with a suitable authority - eg a solicitor specialising in landlord/tenant law...

        Thanks for the comments so far, perhaps I should clear the door up. It's the same UVPC door but with a metal security gate over the front.

        I'll continue to 'pop' round a couple of more times this week and write to them again tomorrow.

        Rather annoying!

        Anyone else kindly advise of what they would do?

          Check with Police. identify yourself as LL and ask if they have had cause to call on property as you are unable to contact the T.
          (metal security gate could suggest something a little more sinister eg drug dealing/cannabis farm)

            i am a landlord and have insurance based deposit protection (I hold the deposit in segregated client account and register it with My Deposits) every time a new contract is drawn up we have to pay £48. If a tenancy is renewed, we pay £48. If someone moves out of one of our multiple tenant...

When the contract started, they found new tenants, did the relevant checks etc and charged an upfront fee which equates to approx one month's rent. As one year has almost passed, the agent has approached me asking if I want them to 'renegotiate'...

            If you have no ongoing contract with the agent and it was "find" only, they have no right to force you into a new AST.

            Depending on the terms of your contract there's nothing to prevent you, if your feeling confident, in renewing the contract yourself and taking over.

            Fees for 'renewing' will not be in the tenancy agreement because they are not fees of the tenancy and are freely negiotiated.

            The landlord should simply charge an admin fee to renew and set it to include all his costs...

            There is no charge and it doesn't need reprotecting if it's in a custodial scheme. If it's in an insurance based scheme then landlord is holding it and can be claiming interest on it, it's therefore very cheeky but not illegal to pass the cost onto you.

            Ask him if he can use a custodial...

            Yes, but if we're talking renewal, then it'll inevitably be in it.

            Is it insured or custodial. Insured, meh. Custodial, wholly unreasonable....
