  • disrepair in the property falling under s.11 Landlord and Tenant Act

    A property was let and managed by an estate agents. The tenants complained of some damp near windows in May 2020. But with the lockdown etc nothing was easy. The tenants have now gone to solicitors who have had a report done and the inspector has found some mould and some defects.

    Hi, hope someone can help. If a tenancy has been offered and a draft tenancy issued but nothing has signed, can the landlord u-turn and change his mind (if he has found out that the prospective tenant has not been truthful)?

    Sure, technically you can withdraw the offer before the prospective tenant signs the contract, but as once stated by I think Lawcruncher on another thread, there's nothing you can do to stop the tenant from claiming they had already signed the contract by the time you inform them you are withdrawing...

    The problem for OP is that the Act says:

    OP did provide false or misleading information to the letting agent by their own admission.

    So it comes down to whether (b) applies. There's no temporal restrictions on when the information was provided or when the landlord...

    With the Tenant Fees Act, I think it doesn't really matter what either parties think the "holding deposit" is for. There's only so much the landlord or their agent can do with such a payment. They can only take one holding deposit, and they are required to return the holding deposit unless...
