    Squatters/ Council tax??

    I have squatters in my property and the council are asking for council tax

    Who is responsible for the council tax here?

    From memory you are, as for anyone to be ahead of you in the order of priority they have to have a right to occupy the property.

      What are you doing about it?

        Re. liability for payment, I believe that residents (inc. squatters) are always ahead of the owner in the priority list. (confirmed by 2 minutes on Google [there's a tip for OP])
        So squatters should pay it.

          jjlandlord is right, I was wrong. The squatters are liable as residents even if they have no right to be in the property.

            Great, so there's a small advantage to squatters residing in the property then

            Might let them stay there until i start work on it ha ha

            How do I prove to the council they're living there? They've requested proof, cheeky buggers...

              The hierarchy of liability is:

              a resident owner-occupier who owns either the leasehold or freehold of all or part of the property
              a resident tenant
              a resident who lives in the property and who is a licensee. This means that they are not a tenant, but have permission to stay there
              any resident living in the property, for example, a squatter
              an owner of the property where no one is resident.
              How do you prove?? Interesting: Have Police been involved & have you got a crime ref number?? Would they accept a signed signed statement from you, if necessary sworn in front of a notary public??

                        The council tax is surely a side issue - what about evicting the squatters? Have you applied for an interim possession order?

                          Surely the water will have dried a week later? If it is still wet you and the tenants are going to have bigger problems that a ruined carpet. The flat will become a ball of mould in a few days.

                          Buy an industrial size dehumidifier and get that carpet out asap
