    Tenants break up

    Hi,

    I'm letting a property under a joint tenancy. The couple have just split up and one of them has moved out. The remaining tenant is happy to continue renting but does not want to start a new 6 month fixed term tenancy. I wondered what I need to do to formalise the situation?

    Has the original tenancy been brought to an end by one or both of the existing tenants? i.e. did you receive notice off of anyone?
    Is the deposit protected?
    Does the remaining tenant have the financial stability to be able to afford the rent on their own?
    My advice is not based on formal legal training but experience gained in 20+ years in the letting industry.

      If you've had no notice from departed tenant I'd leave things as is, as you can still take legal action against both tenants for rent not paid/damage. Neither probably realises this
      I am legally unqualified: If you need to rely on advice check it with a suitable authority - eg a solicitor specialising in landlord/tenant law...

        Quite likely, nothing. One joint tenant vacating does not, in itself, end the joint tenancy, and you can't grant a new tenancy with the joint tenancy in place, anyway.

        What date did the fixed term begin? (dd/mm/yy)
        What is the length of term?
        If the fixed term has expired and the tenancy is periodic, did the tenant who moved out serve notice to quit? If so, what date did the notice expire?
